The agreement
These terms are between you and blackpepper ltd (“we”, “us”). They apply when you download, install or play Zero In (“the game”) or use this website. By doing any of those things you accept these terms. If you do not accept them, please do not use the game.
Our Privacy Policy forms part of these terms and explains what data the game handles.
Your licence to use the game
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play Zero In on Apple devices you own or control, for your own non-commercial use, in line with the App Store Terms of Service.
You may not:
- copy, sell, rent, sub-licence or redistribute the game
- modify, decompile or reverse engineer it, except where that right cannot be excluded by law
- remove or obscure any notice of ownership
- use the name, icon or artwork of Zero In for your own products or promotion without our written permission
The game, its artwork, sound, wordmark and code remain our property or that of our licensors. The Rubik typeface is used under the SIL Open Font License.
The free trial and the purchase
Zero In is free to download and the first ten levels, the whole Easy tier, are free to play for as long as you like. Unlocking the rest of the campaign is a single, one-time purchase of $2,99. There is no subscription and nothing else to buy.
The purchase is a non-consumable in-app purchase sold and processed by Apple, not by us. It is tied to your Apple Account, so you can restore it on any device you own using Settings → Restore Purchases in the game, at no extra cost. Prices are set per storefront and may change; the price shown to you at the time of purchase is the one that applies.
Refunds are handled by Apple under the App Store Terms of Service, not by us. Request one at reportaproblem.apple.com. If you are a consumer in the UK or EEA you may have a statutory right to cancel a digital purchase, which you may lose once the content is delivered and you have agreed to immediate access.
Fair play
Scores are the only thing this game asks you to earn, so please earn them. You agree not to:
- submit scores that were not achieved by playing the game normally
- modify the app, run it on a jailbroken device to alter behaviour, or use tools that play for you
- circumvent, tamper with or fake the purchase check that unlocks the full game
- intercept, replay or forge requests to our servers
- attempt to disrupt the service or gain access to parts of it that are not open to you
The game verifies with Apple that requests come from a genuine, unmodified copy. Where that check fails, scores are refused.
Leaderboard and display names
Setting a display name is optional. If you set one it is shown publicly next to your score, so treat it as public information and do not include personal details.
Names must not be offensive, hateful, sexual, or impersonate another person or brand. We may remove or rename an entry, or block a device from the leaderboard, if a name breaks this rule or a score appears to be fabricated. We do not have to warn you first, and you can ask us to reconsider at [email protected].
The leaderboard is a convenience, not a competition with prizes. We may reset, archive or retire it, for example when the scoring rules change.
Availability and changes
The game itself works offline. The leaderboard depends on our server, which we provide on a best-effort basis with no guaranteed uptime, and which we may change, suspend or withdraw.
We may update the game, add or remove features, and change the scoring or the way levels unlock. If we change these terms we will post the new version here with a new date; continuing to play after that means you accept the change.
No warranty and limits on liability
The game is provided “as is” and “as available”. To the fullest extent permitted by law we exclude all implied warranties, including that the game will be uninterrupted, error free, or fit for a particular purpose.
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of data, or loss of progress or scores. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Where liability cannot be excluded it is limited to the amount you actually paid for the game, or to £50, whichever is greater.
Your statutory rights as a consumer are not affected by these terms.
Apple
This agreement is between you and blackpepper ltd, not with Apple, and Apple is not responsible for the game or its content. Apple has no obligation to provide support for the game. If the game fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price you paid, if any; Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the game, including product liability, legal compliance or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Ending the agreement
You can end it at any time by deleting the game. We may end it if you seriously or repeatedly break these terms. Sections on liability, ownership and governing law survive the end of the agreement.
Governing law
These terms are governed by the laws of United States, and the courts of United States have non-exclusive jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.
